Strength Metrics Gym — Membership Terms & Conditions

Payment. You agree to pay by the payment term selected. If a weekly membership is selected, you authorise Strength Metrics Gym to charge your card automatically each week on the day of sign up and every 7 days thereafter. If you are aware a payment will not be processed you must contact Strength Metrics Gym in advance and arrange an alternative payment method. If you fail to make a payment you will not be eligible to use the facilities. If membership payments are overdue Strength Metrics Gym has the right to engage a debt collector and you will be liable for debt collection fees as well as membership arrears.

Cancellation (Weekly Memberships). Weekly memberships may be cancelled by giving at least two weeks' written notice to Strength Metrics Gym at service@strengthmetrics.com. Notice must be given before the next billing date to avoid that charge being processed.

Lump Sum Payment. If you have selected a 6-monthly or yearly membership term, you understand that refunds are not available.

Refunds. Membership payments will not be refunded by Strength Metrics Gym under any circumstances.

Increase in Membership Fees. Strength Metrics Gym may increase membership fees by giving 1 month's notice emailed to the address supplied. You acknowledge that on expiry of a lump sum membership period, fees may have increased.

Membership Transfer. Memberships may be transferred to a second party by seeking prior approval from Strength Metrics Gym and paying a transfer fee of $25. Approval is at the sole discretion of Strength Metrics Gym.

Liability. Strength Metrics Gym is not liable for any direct, indirect, or consequential injury, loss, or damage to you or your property while at Strength Metrics Gym.

Termination. Strength Metrics Gym has the right to terminate your membership if: (a) you fail to make payment of any fee on a due date; (b) you fail to comply with the gym rules set out at the facility and the membership rules below; or (c) Strength Metrics Gym determines termination is appropriate in the circumstances. Where membership is terminated, Strength Metrics Gym has the right to recover any outstanding membership fees.

Door Code. You must not share the door code with any other person. Breach of this will result in immediate termination of your membership.

Membership Rules. You have the right to enjoy all Strength Metrics Gym facilities. You agree to comply with the facility rules at all times. You will not carry out any illegal acts on the premises and must comply with all health and safety requirements. Strength Metrics Gym reserves the right to restrict membership hours if these rules are broken during non-staffed hours. You will return weights, bars, and equipment to their allocated space and generally keep facilities tidy. During non-staffed hours you agree to turn off all power points, lights, music, fans, and stereos, and ensure the door and roller door are securely locked if you are the last person to leave.

Health Declaration. You confirm that you are in a suitable state of health to undertake strength training. You agree to disclose any injuries or medical conditions that may affect your training. Strength Metrics Gym is not liable for any injury arising from the use of the gym, including injuries relating to pre-existing conditions.

Privacy. Personal information collected through this form is held by Strength Metrics Limited and used solely for the purposes of administering your membership. Your information will not be shared with third parties except as required for payment processing (Stripe) or debt recovery. You have the right to access and correct your information under the Privacy Act 2020.

Gym Closure. Strength Metrics Gym is not liable for any loss arising from temporary closure of the facility due to circumstances beyond its reasonable control, including but not limited to natural disaster, pandemic, or regulatory requirement. No refunds will be issued for such closures unless required by law.

Governing Law. These terms are governed by the laws of New Zealand.
